2. Exceptions to the No Refund Policy:

  • Damaged During Transit: If the goods are damaged solely due to mishandling by our delivery personnel during transport, we will consider a refund or replacement. In such cases, customers must report the damage immediately upon receipt of the item.

  • Proof of Damage: For any claim to be considered, customers are required to provide clear photographic or video evidence showcasing the extent of damage or spoilage. Absent this proof, we cannot process refunds or replacements.


3. Time Constraint for Reporting Damage:

  • Prompt Reporting: To be eligible for a refund or replacement, the damaged or spoiled item must be reported to Culimix's customer service team within a few hours of delivery. Any claims made beyond this time frame will not be entertained.

4. Food and Perishable Goods:

  • No Refund on Food Items: We do not provide refunds for food or food items unless there's evidence that it's spoilt or in an unsatisfactory condition at the time of delivery. Clear photographic or video proof is mandatory.

5. Legal Protection and Terms:

  • Limitation of Liability: Culimix's total liability for any claim arising out of or related to a purchase shall not exceed the amount paid for the product. We shall not be liable for any special, consequential, or incidental damages.

  • Indemnification: By using our services, you agree to indemnify, defend, and hold harmless Culimix, its officers, directors, employees, agents, licensors, suppliers, and any third-party information providers from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of this policy or any activity related to your account.

  • Governing Law: This policy and the use of the Culimix platform shall be governed and construed by the laws of Nairobi, Kenya. Any disputes related to this policy or use of the Culimix platform will be heard in the courts of Nairobi, Kenya.
